§ 1. General Provisions

These Terms of Service ("Terms") govern the use of the Product Shot Studio application ("Application", "Service") provided by the Service Provider.

Product Shot Studio is an AI-powered product photography tool enabling users to upload product images and generate studio-quality AI product images for commercial use. The Service is primarily intended for businesses (B2B) but may also be used by individual users.

The Service is provided electronically under the Polish Act on Providing Services by Electronic Means and applicable EU regulations.

By using the Service, the User confirms that they have read and accepted these Terms and the Privacy Policy.

§ 2. Definitions

  • Price List – current pricing available at: https://productshot.studio/pricing
  • Consumer – a natural person using the Service for purposes not related to business activity.
  • Account – a user account enabling access to the Service.
  • Subscription Period – the monthly or yearly period for which the Service is provided.
  • Subscription Fee – the payment due in exchange for use of the Service.
  • User Content – images, data, and other materials uploaded by the User into the Application.
  • Service Agreement – an agreement concluded electronically upon creation of an Account and payment for a subscription.
  • User – any person or entity using the Application.
  • Service Provider – the entity defined in §1.

§ 3. Technical Requirements and Responsibilities

Proper use of the Service requires:

  • Internet connection,
  • Device capable of accessing the Service,
  • An active email address.

The User must not use malware, bots, harmful scripts, or any actions that may compromise the Application.

The Service Provider uses security measures such as SSL encryption and access control, although full elimination of risks inherent to the Internet cannot be guaranteed.

The Service is paid.

The User must provide accurate data; the Provider is not responsible for consequences resulting from false or incomplete information.

§ 4. Service Agreement

  • Upon purchasing a subscription via Stripe, the User enters into a paid Service Agreement with the Provider.
  • Registration requires selecting either email-based registration or Google OAuth and accepting these Terms and the Privacy Policy.
  • The subscription activates once Stripe confirms payment and the Provider grants access to the Application.
  • Subscriptions renew automatically at the end of each Subscription Period unless canceled.
  • If payment fails, access to the Service may be suspended until the payment is successfully collected.
  • No trial period is offered.
  • A User may delete their Account at any time; however, prepaid Subscription Fees are non-refundable except where required by applicable law.
  • Users retain all their uploaded User Content, subject to removal upon Account deletion as described in §4.9.
  • Account deletion results in permanent removal of User Content following a short archival safety period.

§ 5. Payments

  • All prices are listed in USD/EUR (depending on the User's region) and are tax-exclusive; applicable VAT will be added at checkout.
  • Payments are processed via Stripe.
  • The Subscription Fee is charged automatically at the beginning of each Subscription Period.
  • Lack of payment results in temporary suspension of access to the Application until overdue amounts are settled.

§ 6. Price List

The current Price List is available at https://productshot.studio/pricing

The Provider may update the Price List at any time, with new prices applying only to new or renewed Subscription Periods.

§ 7. Complaints (Consumers only)

This section applies exclusively to Consumers within the meaning of EU law.

The Service Provider must deliver the Service in accordance with applicable consumer rights regulations.

A Consumer may file a complaint via productshotstudio@gmail.com

Complaints should include:

  • name,
  • email address,
  • description of the issue,
  • Consumer's request.

The Provider will respond within 14 days.

If the Service is non-compliant, the Provider will ensure resolution free of charge and within reasonable time.

Consumers may withdraw from the Agreement if the Service remains non-compliant after corrective attempts, or in cases provided by law.

Upon withdrawal, the Account is deleted and access to the Service is terminated.

§ 8. Right of Withdrawal

EU Consumers have the right to withdraw from the Agreement within 14 days of purchase.

Business Users (B2B) do not receive withdrawal rights unless imposed by local law.

§ 9. User Content and Feedback

  • Users may upload product images for the purpose of generating AI-based product photos.
  • Uploading any sensitive data, personal data of third parties, biometric data, or images containing identifiable persons is strictly prohibited.
  • The User represents that they own all rights to uploaded content.
  • The User bears full responsibility for User Content, including infringement of third-party rights.
  • Feedback submitted to the Provider may be used freely for product improvement.

§ 10. Use of Artificial Intelligence

The Application uses third-party AI services, including:

  • Google AI Models,
  • FLUX / Black Forest Labs.

Uploaded product images and prompts may be shared with these providers solely for inference purposes.

AI-generated results may contain inaccuracies and require human verification.

AI-generated content must not be considered legal, medical, or financial advice.

Data submitted to AI providers is not used to train their models.

§ 11. Limitation of Liability

The Service is provided "as is".

The Provider is not liable for:

  • loss of profits,
  • business interruption,
  • indirect or consequential damages,
  • damages caused by misuse of the Application.

For B2B Users, liability is limited to the amount of the last paid Subscription Fee.

Nothing in these Terms excludes liability where prohibited by law.

§ 12. Account Termination

The User may terminate the Agreement by deleting their Account.

The Provider may terminate access with 7 days' notice if the User violates the Terms.

§ 13. Governing Law

These Terms are governed by the laws of Poland and applicable EU regulations.

For B2B Users, all disputes shall be resolved before the courts competent for the Provider's registered address.

§ 14. Final Provisions

The Provider may update these Terms; Users will be notified via email or in-app notice.

Continued use of the Service after changes constitutes acceptance of the new Terms.
